Retrial looms in murder of 2 Ohio students October 19, 2009 03:29 AM WASHINGTON, Pa. (AP) - A former Pittsburgh man again faces a possible death penalty in a retrial in the shooting deaths of two Ohio college students a decade ago. Terrell Yarbrough, 29, is scheduled to go on trial this week in the 1999 deaths of Franciscan University students Aaron Land, 20, of Philadelphia, and Brian Muha, 18, of Westerville, Ohio. Prosecutors say Land and Muha were kidnapped from their Steubenville, Ohio, home and driven to the Pittsburgh suburb of Robinson Township, where they were shot. An Ohio jury convicted Yarbrough in the slayings and sentenced him to death. But in 2004 the Ohio Supreme Court overturned the conviction, saying he and co-defendant Nathan Herring were tried in the wrong state. Both remain in Ohio prisons on convictions of having kidnapped the students and stolen Muha's vehicle. Defense attorney Kenneth Haber said he doesn't believe the evidence proves that his client was the triggerman, as the Ohio jury concluded. He also said he plans to introduce IQ tests and other evidence to prove that Yarbrough is on the borderline of mental retardation. Herring, whose life sentence was tossed out by the Ohio high court, will go on trial after Yarbrough's trial ends. The victims' families say they are frustrated by the failure of the justice system to resolve the case quickly. The proceedings have been postponed nine times in Washington County since 2006. "It became a joke, because of it constantly, constantly, being pushed back," said Muha's mother, Rachel Muha, of the Columbus suburb of Westerville, recalling e-mails sent to relatives about the postponements. "I think it's ridiculous." Land's mother, Kathleen O'Hara, of Philadelphia, said it would be difficult to see the defendant in court again.
