Fayette County constable arrested on drug charges

A certified constable is facing accusations of selling narcotics in two counties.

Michael Scott Mucy, 58, of New Salem was charged in multiple cases in Fayette and Westmoreland counties this week. Online records indicate that Mucy is a constable in Fayette County.

On Tuesday, state police charged Mucy with a misdemeanor of unauthorized use of a motor vehicle. Charging documents state that Mucy was using a pick-up truck that did not belong to him to drive around “multiple counties” to sell methamphetamine.

According to court records, shortly before midnight Monday police were called to the home of the vehicle owner in the 300 block of Fourth Street in Luzerne Township. Police said the man had last seen the truck that morning.

On Wednesday, Uniontown police filed a felony charge of possession of a controlled substance with intent to deliver against Mucy.

According to the criminal complaint, the night of Oct. 31 police saw Mucy sitting in a truck in Mill Street Park. Mucy agreed to let police search the vehicle. Officers found a bong and a small amount of suspected methamphetamine.

Court records state that police had the vehicle towed and obtained a search warrant to conduct a more thorough search. Police allegedly found multiple pieces of drug paraphernalia and about 4.5 ounces of suspected methamphetamine.

Mucy was also charged in Westmoreland County Wednesday by state police on similar charges. Police filed charges through the office of District Judge Charles Moore. Details in that case were not immediately available.

Fayette County District Attorney Mike Aubele confirmed Mucy’s status as a constable. According to Aubele, constables are able to serve warrants, subpoenas and transport prisoners.

“To my knowledge, he was not performing any judicial duties when he was caught with methamphetamine,” Aubele said.

Mucy’s certification will expire Feb. 12, but Aubele said there is a legal process to have him removed by Fayette County’s president judge.

“There is a petition my office can file. We’re likely going to take some action,” Aubele said.

Mucy was arraigned Wednesday afternoon before District Judge Jason Cox, who sent him to the Fayette County jail on $20,000 bond. A preliminary hearing is scheduled for 2 p.m. Jan. 28.
