Suspect charged with assaulting girlfriend, resisting arrest
WAYNESBURG – A Waynesburg man was arrested Sunday following allegations that he assaulted his girlfriend during a domestic dispute and resisted arrest.
Marquell Lawrence Bailey, 23, was arraigned before Magisterial District Judge Glenn Bates and charged with aggravated assault, simple assault, recklessly endangering another person, terroristic threats, probable cause of domestic violence, harassment by physical contact and resisting arrest.
According to the criminal complaint, Waynesburg police Patrolman Marcus Simms responded to a report of a domestic dispute in progress, possibly involving a knife, at Bailey’s residence on Lincoln Street at 1:45 p.m. Sunday; upon arriving, Simms spoke with Glenn Raymond, the father of Bailey’s girlfriend, Corin Raymond, who was observed crying in a room.
Corrin Raymond told Simms that Bailey had struck her multiple times in her face and back and showed a red mark on her back where Bailey allegedly punched her; she then told Simms Bailey was upstairs with their child, according to court records.
Simms proceeded upstairs and requested Corrin or Glenn Raymond to follow him to take the child; Simms then confronted Bailey and asked him multiple times to hand over the child to Glenn Raymond but Bailey refused, the complaint states.
Bailey asked Simms why he had to hand over the child and Simms said because he was being placed under arrest for hitting Corrin Raymond; Bailey then said Corrin Raymond attempted to hit him first, the complaint states.
Bailey handed the child over to Corrin Raymond and attempted to get up and walk out of the room; Simms again stated that he was under arrest and to put his hands behind his back, but Bailey refused to cooperate and when Simms attempted to place his hands behind his back Bailey began fighting with Simms, the complaint states.
Bailey continued to fight as Simms requested for backup, and Simms advised Bailey to stop resisting or else a Taser would be used; as Bailey continued to fight with Simms, he was again given a verbal warning and was eventually tasered without any effect, the complaint states.
Bailey again fought with Simms and attempted to grab him, and Glenn Raymond then assisted Simms by attempting to grab Bailey and hold him on the bed; however, Bailey slipped free from Glenn Raymond and stood up, and Simms then took Bailey down with a leg sweep and held him on the bed, according to reports.
Simms held Bailey on his side and again requested for backup, and Bailey became enraged and attempted to break Simms’ grasp; Simms tactically retreated from the bed and Bailey then stood up and began yelling at Simms, saying that he was going to sue Simms and that he had no right to place his hands on him, the complaint states.
Corrin Raymond then attempted to calm Bailey down, but Bailey struck the door in the corner of the room with his elbow; Simms then blocked the exit to the room and requested Corrin Raymond to stay out of the way, the complaint states.
State police troopers arrived at the scene and attempted to assist Simms in placing Bailey in handcuffs, and Bailey again resisted arrest; after deploying a drive stun technique to subdue Bailey had no effect, police were eventually able to place Bailey’s hands behind his back and handcuff him, according to court records.
As he was being escorted to a patrol car, Bailey continued to resist arrest, and after being transported to the police station, Bailey requested that his handcuffs be loosened; when police asked Bailey if he was going to fight with officers if the cuffs were loosened, Bailey stated, “Not yet.” When asked what that meant, Bailey stated, “Not while (you’re) in uniform.”
Following arraignment, Bailey was placed in Greene County Jail in lieu of $20,000 straight bail.
His preliminary hearing has been scheduled to be held before Bates on Feb. 23.
