Hearings scheduled for suspects charged in drug arrest
WAYNESBURG – Two Waynesburg men are awaiting preliminary hearings for multiple charges following allegations that they were in possession of marijuana and Oxycodone during a police investigation last August.
Brady P. Hogue, 20, and Nicholas S. Swarrow, 21, have each been charged with possession of a controlled substance, possession of drug paraphernalia, corruption of minors and loitering or prowling.
The charges were filed by Waynesburg Borough Police on April 13 before Magisterial District Judge Dave Balint.
According to the suspects’ criminal complaints filed in Balint’s office, police were called to a residence on North Porter Street in the borough at around 9 p.m. Aug. 11 for a report of people sitting in a vehicle trespassing; Greene County 911 advised the officers that the caller had taken a bag of drugs from the trunk of the vehicle.
Upon arrival, police met with the caller, who pointed to the ground near the trunk of the vehicle, a blue Honda Coupe, at the bag of suspected marijuana he had taken from the vehicle’s occupants, the complaint states.
Police then advised the passenger, Hogue, the driver, Swarrow, and a male juvenile sitting in the back to seat to exit the vehicle; inside the vehicle, police found a digital scale with several marijuana buds on top, a bag containing a white glass jar, another bag of suspected marijuana and other paraphernalia, the complaints state.
A further search of the vehicle also resulted in police finding a metal grinder with marijuana residue and several Oxycodone pills, the complaints state.
Police spoke with the caller, who said he was looking after the property for its owner while the house was empty and he had problems with people being there in the past; he also said he observed the vehicle with its interior light on and people sitting inside, and when approached the vehicle he observed the driver holding a bag of marijuana, the complaints state.
He said the driver then passed it to the passenger, who attempted to put it under his leg; he then asked what was in the bag, and the driver said “marijuana”; at this point, the caller took the bag and placed it on the ground at the rear of the vehicle and then called 911, the complaints state.
On March 19, investigating officers received confirmation from the Pa. State Police Greensburg Regional Laboratory that the tested substance was marijuana; following this confirmation, police then filed charges against the two suspects.
Police said the weight of the confiscated marijuana amounted to nearly 15 grams.
Preliminary hearings for the two men have been tentatively scheduled to be held before Balint on May 24.
