Lien claim filed against Greene County medical marijuana growing facility

A lien claim and a breach of contract lawsuit were filed against a medical marijuana growing and manufacturing facility in Greene County.
The suit was filed by attorney James Miller, representing Advanced Masonry as a contractor and subcontractor, against defendants including Greene Energy Resource Recovery LLC, Cumberland Property Leasing LLC and Agrimed Industries of PA LLC.
The claim by Advanced Masonry relates to labor and materials provided by the company to the defendants for the building layout and installation of concrete footings, foundations and floor slabs along with construction of service roads and additional work for a medical marijuana growing/manufacturing facility.
The facility, located at 280 Thomas Road in Carmichaels, is to be operated by Argrimed as the tenant and co-owner of the building along with Cumberland and Greene Energy.
According to the filing, Advanced Masonry completed scope of work and change orders to the facility, along with Accelerated Construction Services.
However, the extra work performed by Advanced Masonry was done based upon alleged oral representations, directions and promises made by the representatives of the defendants. The masonry company alleged they are owed $204,236.86, and filed the claim.
A separate lawsuit filed last week by Accelerated Construction Services through attorney Rochelle R. Koerbel against Cumberland Property Leasing LLC.
That suit claimed the company entered into a written construction contract in August to perform work on the facility for $452,307.
However, in November, six change orders were added to the project’s contract that increased the amount of the contract with Accelerated Construction Service to $1,555,114.80.
In response to eight different payment requests from Accelerated Construction up to February, Cumberland issued payment in the amount of $862,848.64 and informed the company they were entitled to payment in full.
Accelerated Construction completed the work in the contract and the change orders, but Cumberland has allegedly refused to make any payments of the $692,296.16 owed to Accelerated Construction.
Accelerated Construction is seeking the remaining $692,296.16 plus interest, including legal fees.
