Judge declares mistrial
The sexual abuse trial for Charles A. Fuller Sr. ended in a mistrial Monday in Fayette County Court after testimony about his arrest in Oklahoma came out. Fuller, 35, of Midwest City faces three counts of aggravated indecent assault and one count of involuntary deviate sexual intercourse for allegedly abusing a girl between 1993 and 1999. During those times, state police said the girl was between 12 and 17 years old.
Fuller, alleged authorities, abused the girl until she was two months shy of her high school graduation. She went to police in October 2001 and said the alleged abuse occurred at a Lower Hulltown Road home in Dawson Borough.
According to a woman interviewed by police, Fuller abused alcohol and drugs at the time he allegedly abused the girl.
The woman also told police that she saw Fuller with the girl on numerous occasions, but never saw anything of a sexual nature happen.
A jury was selected Monday morning and heard opening remarks in the case, but Fayette County Judge Conrad B. Capuzzi granted the request for a mistrial made by Fuller’s attorney, Assistant Public Defender David Kaiser.
Assistant District Attorney Jack R. Heneks Jr. prosecuted the case.
Fuller recently rejected a five- to 10-year offer in the case.
