Connellsville man sues local bar

By Jennifer Harr 2 min read

A Connellsville man filed suit against the owners of Walt’s Lounge on Route 40 in South Union Township claiming that the bar continued to serve an already intoxicated patron who drunkenly struck him with his car. The suit was filed Monday in the Fayette County Prothonotary’s office on behalf of Kenneth L. Woodall of 240 Prospect St.

Woodall claimed that from the evening of May 11 through the early morning hours of May 12, 2001, Benjamin B. Boyer of Uniontown was served “large quantities” of alcohol when he was visibly drunk.

Boyer, along with Irene D. Kowalczyk and Richard Guziak, the operators of Walt’s, are named in the suit.

Nancy J. Radolec of Lemont Furnace is also named in the suit. Radolec, according to court papers, owned the 1987 Chevrolet Cavalier that Boyer was driving when he reportedly hit Woodall.

The accident occurred along a northbound exit ramp of Route 119 that lead to Bute Road. The suit claims that Boyer hit Woodall, who was a pedestrian at the scene.

Injuries Woodall suffered in the accident include multiple traumas, fractures and lacerations to his body, various internal injuries and “severe disabling injuries to various parts of the body.”

The injuries he sustained have also affected Woodall’s mental and emotional health, according to the suit.

Woodall does not specify an amount in the filing, although the suit indicated that he wanted the case to go to jury trial.
