Mount Pleasant man files suit over accident

Brian Yurchak of Mount Pleasant filed suit against two Fayette County residents, claiming that their negligence caused him to be severely injured. Named as defendants are Ike Brownfield of 183 Kissinger Road, Smithfield, and Jessica Stanec of 344 Craig Lane, Hopwood. Yurchak, through attorney Joseph E. Fieschko Jr., claimed that when he pulled over to help a stranded Stanec along Route 119, Brownfield hit his vehicle and then his body.

Stanec, according to the suit, was in the southbound lane of Route 119 around 5 p.m. on Jan. 6, but was facing north. The suit claims that she was driving too fast for conditions and spun out of control. Yurchak, driving his Jeep Cherokee in the southbound lane, stopped to help Stanec and to direct traffic around her car.

“As (Yurchak) was exiting his vehicle, Brownfield drove his motor vehicle onto the right-hand berm, colliding with Yurchak’s vehicle and colliding with Yurchak’s body,” claims the suit, which asks for judgement in excess of $25,000.

As a result of the accident, Yurchak suffered a brain concussion, severe leg injuries and other various ailments, according to the suit.

The suit alleges Brownfield was driving too fast for conditions and did not keep a good enough look out for things in his path.

Stanec, too, was driving too fast for conditions, alleged the suit. Yurchak also claims that she should have pulled her car to the side of the road.

When he pulled over to help Stanec, Yurchak saw her talking on a cellular telephone. The suit claims she should not have been on the phone, and should have instead pulled her vehicle to the side of the road.

The suit also claims Stanec was using her cellular telephone during the initial accident that disabled her vehicle.

Yurchak’s wife, Crystal, was also named as a plaintiff. She claimed that the negligence of Stanec and Brownfield has forced her to spend large sums of money on care for her husband. She is also suing for loss of his company.
