Zoning board grants company exception for signs

A Bullskin Township property owner along Route 31 was granted a special exception by the Fayette County Zoning Hearing Board Wednesday to erect two outdoor advertising signs. Lamar Advertising will erect the 10-by-23-foot signs on property owned by Advance Environmental Consultants Inc. up the hill from Nino’s Restaurant. In addition to the special exception, the ZHB also approved variances from setback requirements for the signs. The variances are for the distances of 27 feet and 43 feet. The nearest home is 600 to 700 feet away.

Matt Wilds of Lamar Advertising said the slope of the property makes it necessary for the variances. Mark Morrison and Charles Cieszynski voted in favor of the motions.

In another hearing, the ZHB heard testimony from Blanche Chearney, who wishes to subdivide her property on Chearney Road in Saltlick Township into two parcels. The A-1 agricultural rural property includes an existing home, garage and cinder block building. Chearney is seeking a variance from setback requirements, which is necessary for the subdivision, although the buildings were constructed prior to adoption of the zoning ordinance.

Chearney said she plans to sell the house, which receives water from a spring on the property. However, the spring will not be a part of the property that is to be sold. The property that holds the spring will be sold to her daughter, who lives on adjoining property and also uses the spring for her water supply. ZHB solicitor Gretchen Mundorff said the board needs a copy of an agreement allowing the future homeowner access to the spring, since public water is not available.

The board could not rule because an exact distance for the requested variances was not provided. The ZHB decided to keep the record open until the needed information is received.

Two other hearings that were scheduled for Wednesday were not held. George E. Martin of North Union Township was requesting a variance from setback requirements, but did not appear.

The board also opted to delay a hearing asking for the reversal of a decision by the county planning commission. The hearing was rescheduled for 1:30 p.m. on Nov. 27. Robert R. Crider Jr., David Crider, Paul Mulligan and Robert R. Cider Sr. are requesting the reversal of a decision by the planning commission approving the land development plan for the Indian Creek Camplands in Springfield Township.
