Authority to see $171,000 from Fay-Penn Fiber

DUNBAR TWP.- The solicitor for the North Fayette County Municipal Authority will file a $171,216 lien in the Fayette County Court within the next week against Fay-Penn Fiber Inc. on a property foreclosure. Michael Macko said it was important to protect the authority’s position in the matter and filed a lien against the property since it was the firm’s only asset on record subject to the mortgage.

The lien involves the firm’s foreclosure of property in the Fayette Business Park in Georges Township, in which the authority made an agreement with Fay-Penn Fiber in 1998 for the minimum purchase of three million gallons of water for May through August.

Fay-Penn Fiber has already entered the 10 percent penalty phase for failing to pay the authority $171,000 before Oct. 1 under the initial agreement.

Fay-Penn Fiber is owned by Clarion Fiber Inc., of DePere, Wis., which purchased 70 acres in 1999 for $1. 8 million from Fayette Industrial Fund, the park’s owner.

In an unrelated matter, the authority awarded American Carbon Services of Glenshaw a $15,625 contract to furnish and install a minimum of 24 inches of granular activated carbon to the plant’s filter. American Carbon Services was the lowest bidder aside from Envirotrol of Sewickley, which did not submit a bid.

In another contract matter, the authority agreed to hire Rygiel Excavating and Hauling of Fayette City to install a six-inch water main along Breeding Hill Road in Franklin Township at a cost of $30,230.

Because the project is being funded by a grant obtained by the township supervisors, authority manager Bob Softcheck said Rygiel would have to eliminate the last 300 feet of water line in order to stay within the amount of the grant.

Softcheck said the change will affect one customer which amounts to about $4,000.

Rygiel was the lowest of five bidders for the project.
