Man convicted of assault files notice of appeal
A Rices Landing man convicted of aggravated assault in a bar fight that led to a death has filed a notice of appeal to the state Superior Court. Brandon Lee Teasdale, through his attorney, Michael Healey, filed the notice of appeal last week. The case was posted Monday on the Superior Court’s Web site.
Police charged Teasdale with criminal homicide in the death of Mike (David) Myers, who died after a Dec. 21, 2002, bar fight outside the Jefferson Hotel in Greene County.
Teasdale, by his own admission, hit Myers, who fell to the ground and hit his head. However, Teasdale testified at his trial that he only hit Myers as a result of his Marine training. He said he felt Myers was going to hit him first.
Jurors ultimately acquitted Teasdale of criminal homicide, but convicted him of aggravated assault. Judge H. Terry Grimes sentenced Teasdale to 4 1/2 to 9 years in prison.
The notice of appeal does not indicate the precise reasons Teasdale hopes to win a new trial.
