Prison lieutenant returns to work after charges dropped
Criminal charges against a Fayette County Prison lieutenant were dismissed Monday, the day he returned to work following an indefinite suspension. Fairchance District Justice Randy Abraham dismissed the six charges against Lt. Mark Richard Schiffbauer, 47, Morgantown Street, Fairchance, after the alleged victim did not appear to testify at Monday’s preliminary hearing.
He also dismissed charges against co-defendants Tracy Lou Schiffbauer and Parish T. George.
According to an affidavit filed by state police, all three people went to Mark Foster Sr.’s home on Mountain View Street in Smithfield on Feb. 7 at 11:30 p.m.
Mark and Tracy Schiffbuaer allegedly pointed a gun at Foster and threatened to kill him and his son, David Matthews.
Mr. Schiffbauer and George allegedly struck Matthews one time each in the head with their fists, police said.
Mr. Schiffbauer was charged with firearms not to be carried with out a license, two counts of terroristic threats, simple assault, recklessly endangering another person, summary harassment and summary disorderly conduct.
Tracy Schiffbauer was charged with terroristic threats, simple assault, recklessly endangering another person and summary harassment. George was charged with summary harassment.
Prison Warden Larry Medlock said Mr. Schiffbauer returned to work Monday. Medlock said he was suspended indefinitely without pay last week.
Medlock said it is up to the prison board to determine if any further action will be taken at its regular meeting, which is scheduled for March 26.
The board has scheduled a special meeting for a personnel matter today at 1:30 p.m.
