Man waives assault charges to court
WHARTON TWP. – Warren Lee McDaniel, 31, of Albright, W.Va., waived his right to a preliminary hearing Wednesday on charges filed by state police alleging that he assaulted four people at the Traveler’s Rest bar on Sept. 25. McDaniel, who is free on bail, waived the hearing before District Justice Wendy Dennis in Farmington.
The charges against him will be forwarded to county court, where he either will have a trial or accept a plea bargain.
Police charged McDaniel and Blair R. Jones Jr., 48, of 743 Dinnerbell-Ohiopyle Road, Ohiopyle, in the incident.
A hearing for Jones also scheduled for Wednesday was continued, and a new date has not yet been set. He is also free on bail.
McDaniel faces two counts of aggravated assault, conspiracy to commit aggravated assault, four counts of simple assault, conspiracy to commit simple assault, criminal mischief and four counts of harassment.
Jones has been charged with aggravated assault, conspiracy to commit aggravated assault, simple assault, conspiracy to commit simple assault and harassment.
Police said they used a baton and a walking stick against three females and a male. All four were injured, and the three females were treated at Uniontown Hospital. One suffered two fractured vertebrae, another had a cut on her head that was closed with five staples and the third had bruises and cuts.
