Official’s hearing continued

MASONTOWN – A preliminary hearing into a theft charge against a borough councilman was continued Monday when a prosecution witness did not show up. Magisterial District Judge Brenda K. Cavalcante granted the continuance in the hearing for Councilman Joseph Volansky, 51, of 511 E. Church Ave., at the request of Assistant District Attorney Jason Adams, and rescheduled the hearing for Sept. 12 at 1:30 p.m.

According to a criminal complaint filed by Masontown police, the borough, in 2000, paid a business that Volansky owned, Home Care Services, more than $11,000 to repair or replace sidewalks along Main Street and West Church Avenue, but the company had failed to do the work as of May this year.

Scottdale Insurance Co. paid Volansky a check for the agreed upon amount of $11,109, but the complaint does not say when the sum was paid.

On June 15, 2001, Volansky sent a letter to the council, stating that the work would be started as soon as fill dirt was placed in the lot and the ground settled, according to the complaint.

He also referred any questions about the matter to himself at his address and phone number, police said.

The fill dirt was placed in the lot shortly after June 15, 2001, but the council received a letter from the property owner on May 31, 2005, asking why the work was not completed, police said.

Attorney Joseph E. Ferens Jr. represented Volansky.
