Connellsville car dealer seeks ARD

A Connellsville car dealer accused of selling vehicles without completing odometer disclosure statements and not telling buyers that vehicles they purchased had been wrecked has applied to be part of a pretrial diversionary program. James Harold Davies, owner and vice president of Davies Ford at 2251 Memorial Blvd., applied to be a part of Fayette County’s Accelerated Rehabilitative Disposition (ARD) program on Monday.

If he is accepted into the program, which is not considered an admission of guilt, Davies will serve a probationary term. If he completes that term, his record will be expunged.

Davies is charged with selling 20 vehicles without completing the odometer disclosure statement, not submitting sales taxes and fees to the state on four vehicles without 20 days and not telling two men that vehicles they purchased had been involved in wrecks and were repaired.

State police started investigating after those men called the Uniontown barracks to complain that they bought vehicles from Davies believing they never were wrecked. The men independently noticed that the vehicles had frame damage and further checked the vehicle histories, police said.

Davies faces 20 felony charges and three summary citations. He initially faced 87 additional summary offenses, but police agreed to withdraw those at Davies’ preliminary hearing earlier this year.

At the time of that hearing, Davies and prosecutors tentatively agreed to his participation in the ARD program.
