Court denies request
A Fayette County judge issued an order Friday denying a request for an injunction to stop Wharton Township from building a cul-de-sac at the end of Marker Road. Marker Road property owners Allyson V. Pallay, Bart F. Bigham, Jason W. Ashman and Garret S. Ashman filed the complaint seeking the injunction.
Judge Gerald R. Solomon dismissed the complaint because the township has not yet started constructing the turnaround, but his order allows the plaintiffs to refile the complaint if the work begins.
At a hearing scheduled for 6 p.m. Monday, the township supervisors will accept public comment on a proposed ordinance that would allow for construction of the turnaround. The ordinance contained three options for laying out the cul-de-sac.
The supervisors will vote on the ordinance and one of the layouts at a regular meeting, which will start immediately after the hearing.
Township residents presented the supervisors with a petition signed by 70 to 80 people, including Marker Road residents supporting the turnaround location.
The residents said land at the end of the road has been used as a turnaround since the 1950s.
