Zoning request denied

The Fayette County Zoning Hearing Board denied a request for a special exception for an animal rescue shelter, which is currently operating without a state license, on 30 acres that straddle the Luzerne-Redstone township line off Route 166. Board members voted against the special exception Wednesday, according to the county planning, zoning and community development office.

The vote came after the board held a hearing on the application July 20 and just more than a year after the board first denied the same request.

Rollin and Paula Barber, owners of Faithful But Forgotten Friends Animal Rescue and Placement Inc., applied for a special exception to operate the shelter on the property, zoned for agricultural use.

After the board denied their first application last June, they appealed the decision to Common Pleas Court and the court remanded the case to the board.

At Wednesday’s hearing, Paula Barber told the board that the shelter’s rescue license expired at the end of last year, but a new license is pending.

Several of the Barbers’ neighbors opposed to the special exception testified that the dozens of dogs at the shelter bark day and night, creating an almost constant nuisance.
