Couple settles dog-attack lawsuit
An Indiana couple, formerly of Fayette County, settled a civil suit that arose from a dog bite their young son suffered in 2002 for $17,500. Under the terms of the court settlement, Timothy and Jennifer Kitchen will receive $10,146.11 for any future surgery their son, Micah, needs to remove scars from his face. An additional $7,353.89 will go toward attorney and other case fees and a lien filed against the Kitchens by Highmark Blue Shield.
On May 3, 2002, Micah Kitchen, then age 5, was bitten multiple times on his face by Janet Williams’ miniature poodle. At the time, the Kitchens were Williams’ neighbors on Buttermore Boulevard in Bullskin Township.
The child sustained injuries to his face and eye, and had to get stitches, according to court records. The youngster also had to go to a pediatric plastic surgeon as a result of the alleged attack, a complaint filed in the case stated.
The complaint also indicates that Micah Kitchen was playing on Williams’ porch when the dog bit him. The dog was not restrained, the complaint alleged.
Williams died in August 2002, three months after the dog bite, so administrators from her estate reached the settlement..
The original suit asked for money to compensate the child for injuries and post-traumatic stress.
