Appeal planned
BELLEFONTE – The Centre County Public Defender’s Office filed notice of appeal Monday to the state’s Superior Court on behalf of convicted murderer Andrew Rogers. County Assistant Public Defender Casey McClain did not reveal what issues he plans to raise before the court in his appeal for Rogers, formerly of Uniontown, who was convicted in April of murdering an acquaintance and cocaine supplier inside of Rogers’ home in February 2006.
A gag order placed on the defense and the Centre County District Attorney1s Office relative to the case remains in place, so the sides could not comment Monday.
Rogers has been sentenced by Centre County Judge Bradley P. Lunsford to serve the maximum 20 to 40 years in state prison for his conviction on third-degree murder.
The defense appealed the length of the sentence and asked for a new trial, arguing that two jurors since have come forward and said they regretted their votes to convict Rogers. Those motions were denied last week.
