Woman held on charges
A former Masontown woman accused of homicide by vehicle will stand trial after all charges against her were bound for court during a preliminary hearing Thursday. Nicole Marie Divver, 34, of King George, Va., was charged with homicide by vehicle, homicide by vehicle while driving under the influence of alcohol and driving under the influence of alcohol and drugs. She was charged before Magisterial District Judge Randy Abraham. Abraham held all charges against Divver for Fayette County Court and remanded her to the Fayette County Prison on $100,000 straight cash bond.
Virginia law enforcement officials took Divver into custody in mid-February after a tip led police to her home, Masontown police Chief Richard Barron said.
She is accused of the homicide by vehicle in the Oct. 22 death of Donald R. David of Hibbs, who was a passenger in her vehicle.
The fatal crash occurred at 2:22 a.m. at the intersection of North Main Street and Harbison Avenue in Masontown.
The pickup truck Divver was driving sheared a utility pole and then overturned, according to Barron. Masontown police officers Timothy Sheehan and Scott Miller were able to get David out of the overturned vehicle, while Divver remained trapped in the truck, upside down, with her arm pinned beneath the vehicle.
Fayette Emergency Medical Services crews initially took David to Uniontown Hospital.
He later died as a result of head trauma, according to Barron.
