Charges held to court against man accused of assaulting police officer
Uniontown police said Terry Walker, 39, was charged before Senior Magisterial District Judge Michael Rubish with aggravated assault, simple assault, resisting arrest and disorderly conduct after he allegedly assaulted Sgt. Fred Balsley at the Sunoco A-Plus convenience store on Connellsville Street at 2:20 a.m. Sept. 2. Rubish held all charges against Walker to Fayette County Court following a preliminary hearing Tuesday.
According to Officer Michael C. Garrow Sr., the incident began when police were called to the store for a report of a woman screaming at an employee and throwing things at her.
Officer Jennifer Field testified Tuesday that when she arrived she found Walker and his wife, Terri Walker, also of Uniontown, in the parking lot of the store.
Field testified that she left the couple in the parking lot with Balsley when he arrived at the store and she went inside the business to interview Mia Grady of Uniontown, Garrow said.
While Balsley was outside with the couple, Terry Walker went back in the store and allegedly told Grady, “We don’t need this. We don’t need this,” Field testified.
Field testified that the fight between Terri Walker and Grady regarded an alleged relationship between Terry Walker and the store clerk.
Field testified that after speaking to Grady, Terry Walker started to argue with Field and told her that she would not be arresting anyone.
Balsley told Fayette County Assistant District Attorney Jack R. Heneks Jr. that he then entered the store and ordered Terry Walker to calm down. He testified that Terry Walker instead called him a pig and became more belligerent.
Balsley testified that he then told Terry Walker he was under arrest and attempted to handcuff him. A scuffle ensued, during which Balsley shot Terry Walker with a Taser gun, Balsley testified.
Terry Walker was able to pull the Taser probes from his stomach area and started to run from the store while still struggling with Balsley for control of the Taser, Balsley testified.
Balsley testified that he and Terry Walker struggled to the entrance of the store, where Terry Walker turned and punched him in the face.
Field then fired her Taser and struck Terry Walker while he was exiting the door of the store, Balsley testified.
Balsley testified that Terry Walker was still able to get up after the second Taser shot and flee the scene. He was later taken into custody at a home in Uniontown.
Balsley testified that he suffered injuries to his chin, jaw and neck and remains under medical treatment for his injuries.
Grady was called as a witness for Terry Walker and told the court that she did not have an intimate relationship with Terry Walker, that she did not see him punch Balsley in the face and that Balsley initiated the altercation.
However, under cross-examination, Grady admitted that her testimony Tuesday directly contradicted a written question-and-answer session regarding the altercation that Grady had with police Chief Jason A. Cox following the incident.
Additionally, attorneys for Terry Walker played surveillance video from the store showing the incident. The video, which had no sound, clearly showed a struggle between Balsley and Terry Walker and also showed Balsley getting punched in the face.
Terry Walker remains free after posting $10,000 straight cash bond.
