Charges dismissed in burglary case

All charges were dismissed against two Uniontown residents accused of breaking into a North Union Township home in August after the alleged victims failed to appear in court Wednesday. Trooper David L. Bell said Samuel Joseph Kiss, 22, of Millview Street, was charged before Magisterial District Judge Randy S. Abraham with robbery, criminal conspiracy to commit robbery, burglary, simple assault and recklessly endangering another person. Additionally, Tiffany Lynn Evans, 18, also of Millview Street, was charged before Abraham with conspiracy to commit robbery, burglary, simple assault and recklessly endangering another person.

According to Bell, the charges were filed against Kiss and Evans after they broke into the Whyle Street home of James Ayers on Aug. 17.

During a preliminary hearing held before Magisterial District Judge Wendy D. Dennis Wednesday, the alleged victims in the case did not appear and Dennis dismissed the charges.

The dismissal comes just two weeks after the couple waived burglary charges to court for a break-in that occurred in Uniontown in early August.

The charges in North Union Township were filed after the duo broke into Ayers home around 6 a.m., Bell said.

Ayers told police that he awoke on the sofa in his living room and saw someone standing nearby.

Bell said that Kiss then came into the living room wielding a shotgun and ordered Ayers onto the floor. Kiss then instructed Evans to “watch” Ayers as he moved into a different area of the home, Bell said.

Ayers told police that Evans then brandished a handgun and held him at gunpoint, Bell said.

Kiss then went upstairs in the home, where he encountered Khalles Lewis and Jeneane Ayers, Bell said.

After stealing money from Jeneane Ayers and Lewis, Kiss and Evans fled the home, Bell said.

Both suspects remain in the Fayette County Prison on the other burglary charges.
