Normalville couple sues mining corporation
A Normalville couple sued Amerikohl Mining in Fayette County Court, claiming that the company owes them almost $27,000 in royalties for mining on their properties. The suit was filed by Earl B. and Marlene Geary, who indicated that the royalties relate to coal mined from four of their properties between March 2008 and June 2009.
The properties were leased to Amerikohl, a Butler company, in 2006, according to the suit.
Under the contract, the company agreed to pay the Gearys $2.85 per net ton of the coal, or 7 percent of the pit price, whichever is the greater amount.
The company breached the contract when they paid the Gearys based on average pit prices, the suit contended.
The suit notes that Amerikohl paid the Gearys $651,226 in royalties during the relevant mining period.
