Local men sue railway

Two Fayette County men sued Norfolk Southern Railway Co., claiming they were injured at working. Michael Homer of 213 New Salem Road in Uniontown and Harry J. Rutherford of 358 Westbend Road in East Millsboro claimed that years of working at the company’s Conway Yard in Beaver County left them with damaged hearing.

Homer, employed from 1975 until 2007, worked as a machinist and Rutherford, employed from 1977 until 2009, worked as a boilermaker, according to the suit.

Attorney Joseph E. Fieschko Jr. claimed in the suit that the Virginia-based parent company didn’t provide a safe workplace and gave workers defective or dangerous equipment to use.

The suit did not specify how Homer and Rutherford was injured, but said because of their employment, the men “+suffered damage to their ears and suffered an inability to hear.”

The hearing problems are permanent, according to the suit, and will result in lifelong medical bills.

Fieschko asked for an award in excess of $50,000.
