Charges against two men held for court
Two of three Fayette County men charged for allegedly assaulting a man at a bar in Uniontown in October will stand trial.
Uniontown police Officer Travis Shandor said Michael Joseph Volek II, 30, and Joseph P. Volek, 28, both of 110 Zebley Road, Georges Township, were each charged with aggravated assault, simple assault, riot, disorderly conduct and harassment following an attack on Cory James Over, 22, of Uniontown.
Magisterial District Judge Michael M. Metros bound most charges against the men for Fayette County Court following a preliminary hearing Tuesday.
Shandor said that the riot charges against both men were dismissed.
Additionally, all charges were dismissed Tuesday against a third suspect, Brian D. Welch, 33, of 791 York Run Road, Georges Township, who had initially been charged in addition to Michael and Joseph Volek in the assault.
Shandor said the charges were filed against the men following an incident at Darby’s Pub on Morgantown Street Oct. 7 as Over waited for a drink at the bar.
Over told police that while he was waiting for a drink he felt something strike him in the head and turned around to see Michael Volek glaring at him, Shandor said.
Shandor noted that Over is dating Michael Volek’s ex-girlfriend.
Shandor said Over continued to wait for his drink but was approached from behind by Michael Volek and the other men.
Over told police that he grabbed Volek and tried to use him as a shield against Joseph Volek and Welsh as they tried to get to him. Shandor said that during the scuffle, Over and Michael Volek toppled to the floor of the establishment, Shandor said.
Shandor said once Over was on the floor, Welsh and Joseph Volek began to pummel him with punches and kicks, while Michael Volek attempted to gouge his eyes with his thumbs.
Shandor said Over suffered multiple injuries to his head, face and back.
