Circuit judge rules against Brownsville school teacher

A circuit judge ruled that a former Brownsville Area School District teacher cannot force the school board to accept a mediated settlement in the civil suit he brought. Frank Bobeck’s attorney filed paperwork last month that asked a judge to force the district to make good on a $5,000 settlement that attorneys for both sides negotiated. However, a district attorney said that accepting or rejecting a negotiated settlement is within the school board’s purview.

In a one-sentence order denying the request, Circuit Judge D. Books Smith agreed with the district’s position.

Bobeck sued the district and several officials in 2006, claiming he was forced to resign his teaching job after he complained about conditions, including a lack of supplies.

A judge in the Western District Court dismissed the lawsuit, but Bobeck appealed to the 3rd Circuit Court.
