New Salem man faces drug charges following fight

By Josh Krysak 2 min read

?A New Salem man who suffered injuries when his son, who police said was in a drunken rage, struck him in the head with a table March 31, now faces charges of drug possession.

Redstone Township police Officer Norman L. Howard III said Jonathan Cellus Daye was charged before Magisterial District Judge Mike Defino Jr. with possession of marijuana and possession of drug paraphernalia.

Earlier this month, Howard said he filed charges against Daye’s son, Jeffrey Allen Daye, 26, also of New Salem. Charges against him include aggravated assault, simple assault, recklessly endangering another person and harassment, after he allegedly assaulted his father with a table.

According to Howard, the incident occurred when Jeffrey Daye and his father got into a fight at their residence on New Salem Road shortly before 11?p.m. March 11. Howard said that the two men had been drinking whiskey and that Jeffrey Daye started to attack his father, apparently unprovoked.

During the fight, Howard said that the men caused extensive damage to the living room and kitchen of the residence while scuffling.

When the fight entered the kitchen, Howard said Jeffrey Daye picked up a small table and struck his father in the head with it.

When officers arrived at the home, they found Jeffrey Daye lying on top of Jonathan Daye in the middle of the blood-spattered kitchen floor, Howard said.

He noted that Jonathan Daye had his son in a headlock.

Jonathan Daye told police that if he hadn’t kept his son in a headlock until police arrived, Jeffrey Daye would have killed him.

He also told investigators that his son had consumed “a large amount” of Black Velvet prior to the altercation, Howard said.

Both men were taken by ambulance to Uniontown Hospital for medical treatment.

Howard said that he found a pipe used for smoking marijuana in the kitchen and also found a tin with marijuana inside in an adjacent room.

A woman at the residence, Patricia Astolas of New Salem, told police that she witnessed the scuffle and also told police that Jeffrey Daye threw cat litter in her face during the fight. She was not injured.

Preliminary hearings for both men will be held at a later date before Defino.
