Charges dismissed in alleged rape case after victim refuses to testify

All charges were dismissed against a Uniontown man accused of conspiring with another man to rape a woman last month in Uniontown after the alleged victim failed to testify against him today.

Uniontown police said Davon Lamar White, 30, and alleged co-conspirator Stephen Kirk Boatright II, 31, both of Uniontown, were charged before Magisterial District Judge Michael M. Metros following the incident March 24.

White was charged with rape, criminal conspiracy to commit rape and indecent assault.

During a preliminary hearing this morning before Magisterial District Judge Michael M. Metros, all charges against White were dismissed after the woman refused to testify against him.

Boatright, who was charged with criminal conspiracy to commit rape, two counts of simple assault and terroristic threats, was held for court March 29 on all charges filed against him.

The alleged victim did testify in the that case.
