Zoning board continues to take testimony in surface mining case

Testimony resumed Wednesday as the Fayette County Zoning Hearing Board determines whether it will grant permission for a mining company to begin operations at a Dunbar Township property.

Neiswonger Construction Inc. of Strattanville is seeking a special exception permit to conduct surface mining and blasting operations on agricultural/rural-zoned property owned by John Tabaj, a Dunbar Township supervisor.

Laurel Hill Presbyterian Church, located adjacent to the mining site, is objecting to the issuance of the special exception permits.

Neiswonger has obtained authorization from the state Department of Environmental Protection (DEP) to conduct surfacing mining operations. A blasting permit was issued in late July, but suspended when the blasting firm allegedly violated permit regulations.
