Robbery charges dismissed against Uniontown couple
Robbery charges were dismissed Wednesday against a Uniontown couple accused of a daytime heist at a grocery store in South Union Township earlier this month.
State police Trooper Andrew Prizzi said Christopher E. Mills, 38, was charged before Magisterial District Judge Joseph M. George Jr. with aggravated assault, robbery, criminal conspiracy to commit robbery, retail theft, criminal conspiracy to commit retail theft, disorderly conduct and harassment.
His alleged conspirator, Amy Lynn Agnew, 39, was charged with criminal conspiracy to commit robbery and retail theft.
During a preliminary hearing before George on Wednesday, prosecutors amended the complaint filed against Mills and withdrew the aggravated assault charge and replaced it with charges of simple assault and conspiracy to commit simple assault.
Following the hearing, George dismissed the robbery count filed against Mills and the conspiracy to commit robbery charge against Agnew and held all remaining charges against the couple to Fayette County Court.
According to Prizzi, the robbery occurred at noon at Adrian’s Market on Route 40 when the couple entered the grocery store and placed about $170 worth of meat products into a basket.
Prizzi said Agnew was confronted by store employee John C. Frayvolt when Agnew attempted to leave the store without paying for the meat.
As Frayvolt tried to stop Agnew from leaving, Mills attacked him from behind and punched him in the face six times before fleeing the store.
Frayvolt suffered multiple injuries to his face and head and his glasses and hearing aid were broken during the attack, Prizzi said.
Agnew was captured by state constables and Uniontown police after she was spotted in the alleged getaway car at a location in Uniontown later that day.
Mills turned himself in to police the following day.
