Father withdraws complaint in son’s death

The father of a man who committed suicide while in the Fayette County Prison on Thursday withdrew the lawsuit he filed in federal court.

Attorney David J. Millstein filed a notice of voluntary dismissal of the lawsuit he filed in Cade Stevens’ death on behalf of Stevens’ father, Williams Stevens.

Cade Stevens, 25, of Dawson, hung himself in the lockup on Sept. 12, 2009, and William Stevens, and Cade Stevens’ mother, Shannon Ferencz, sued the prison separately for negligence.

In an order issued last week, Fayette Country Judge Steve P. Leskinen rescinded an order that gave William Stevens the ability to file a complaint in his son’s death. Before William Stevens filed his suit, Ferencz filed a complaint. Her complaint was filed only a few hours before his was.

As the administratrix of the estate, Ferencz has the legal right to sue on her son’s behalf.
