Judge recommends suit be dismissed

A federal magistrate recommended that a lawsuit filed against Fayette County and a former prosecutor be dismissed, but gave the plaintiff a chance to amend certain parts of his complaint. Stanley Ohler St., 35, of Connellsville sued last year, claiming he was wrongly prosecuted for a rape of which he was ultimately acquitted, and alleged that police, prosecutors and the victim conspired to frame him.

U.S. Magistrate Judge Cathy Bissoon ruled Wednesday that Ohler could have time to amend his a portion of his complaint against Fayette County, Assistant District Attorney Phyllis A. Jin and former chief prosecutor Nancy D. Vernon, now a judge in Common Pleas Court.

Bissoon said Ohler could flesh out an argument that Jin, Vernon and the county were liable because there was a lack of training.

Other counts brought against them were dismissed with prejudice, meaning there is no chance to amend those claims.
