Trucker appeals sentence

An Alabama truck driver has filed a second appeal of the 6-to 22-month prison sentence he received in Greene County Court for killing two men from Michigan in a crash on Interstate 79 in 2008.

David Trent Elrod, 43, of Wellington appealed the sentence to the state Supreme Court on Thursday after the state Superior Court denied his appeal in January, according to court records.

In a non-jury trial in August 2009, Greene County Judge Farley Toothman found Elrod guilty of two counts of homicide by vehicle and summary traffic violations for killing David Wimert, 46, and Terry Caryl, 47, both of Port Huron.

The tractor-trailer Elrod was driving rear-ended the Ford truck Wimert and Caryl were in and pushed it into another tractor-trailer in front of it on April 15, 2008, state police said.

The vehicles were traveling south between the Waynesburg and Kirby exits at about 11:44 a.m. when the collision occurred, police said.
