Smithfield man to stand trial on escape charges
?A Smithfield man accused of resisting arrest and running from police Sunday waived all charges against him to court Thursday.
Masontown police Officer Robert Kelly II said Bruce Anthony Balsega Jr., 24, of 303 Jacobs Creek Road was charged with escape, flight to avoid apprehension, obstruction of law enforcement, disarming an officer, defiant trespassing, criminal mischief and public drunkenness following the incident.
During a preliminary hearing Thursday before Magisterial District Judge Randy S. Abraham, Balsega waived all charges against him to Fayette County Court. Kelly said the charges were filed after police found Balsega reeking of alcohol and passed out on the steps of the future borough building on Back Lane.
Kelly said that as officers attended to him he jumped up and started to run on Back Lane.
Kelly said that Balsega refused to stop and comply with police commands so he deployed his Taser, striking Balsega on his right side and knocking him on the ground.
After several more shocks from the Taser, Kelly said he was able to get Balsega handcuffed and on his feet. At that time police emergency personnel began to assess Balsega, but Kelly said he ripped off a blood pressure cuff that had been placed on his arm and began to run again. This time, Balsega made it several blocks before being stopped by another patrolman on East Church Street.
Kelly said Balsega was then placed in a patrol car and driven to the police station, where he broke free from officers a third time and began to run along Green Lane.
Kelly said that another patrolman deployed his Taser and took Balsega to the ground, where he was then held by K9 officer Brony.
Police were eventually able to get him into the patrol car again, where he attempted to climb out a window and then was able to get one of the doors of the car open and tried to get out of the vehicle.
Kelly said that he continued to use his Taser on Balsega with little effect and noted that Balsega actually attempted to gain control of the Taser from Kelly during the scuffle.
Police also used pepper spray in an attempt to contain Balsega during the incident.
Balsega remains in the Fayette County Prison on $30,000 straight cash bond.
