Man acquitted in theft case
A Las Vegas man accused of bilking a Fayette County couple out of $4,500 for a vintage car was acquitted of theft during this month’s term of criminal court week.
Richard Anthony Gutierrez, 45, was charged with theft by deception after he allegedly collected the money, sent via MoneyGram, from David and Cheryl Barnhart of Fairchance in November 2007. The couple had wired money to purchase a 1969 Chevrolet Camaro that was supposed to be shipped to their home from Texas.
Gutierrez told state police that he picked up the money at a Nevada store on behalf of some Romanians he could not identify and delivered the funds to them.
The trial was held before President Judge Gerald R. Solomon.
In an unrelated case, Albert Theodore Greeley III, 30, of Uniontown was convicted of possession and possession with the intent to deliver 124 grams of cocaine in October 2008.
Greeley was charged after a traffic stop on Vardnell Street in Uniontown on Oct. 30, 2008.
He was supposed to go to trial in February 2010, but skipped out of court, and was picked up on a bench warrant several months later.
Judge Ralph C. Warman, who conducted the trial, will sentence him at a later date.
Other matters tried this month include:
n Wayne Edward Bailey, 37, of Smock was found not guilty of resisting arrest and disorderly conduct relating to an alleged incident on Oct. 10, 2010, in North Union Township.
n Jacob James Starfire IV, 37, of Grindstone was acquitted of retail theft relating to an alleged incident on Oct. 27, 2008, in Brownsville.
