Court affirms landlord’s dismissal from dog-bite suit

The state Superior Court upheld that a Fayette County landlord should not be held responsible in a civil suit brought against him by the mother of a boy who was bitten by a dog.

Rhonda L. Rosenberry sued Robert Miller and others on behalf of her son, Alexander W. Prince. Her lawsuit claimed when Prince was age 10, he and his grandparents went to property that Miller leased to Mitchell King to pick up a pit bull puppy from a litter born to a dog owned by Tanya Evans.

While he was there on June 15, 2008, the puppies’ mother bit him in the nose.

The suit names Miller, King, Evans and Prince’s grandparents, Dale and Linda Cannon.

The appellate court ruling only deals with Miller being dismissed from the suit because a Fayette County judge found that Miller did not know the dog was dangerous and Rosenberry did not prove that the animal was dangerous.

Her suit alleged that Miller, King and Evans should have known that the dog was dangerous.

The ruling affirms that Miller should be dismissed from the lawsuit, which has yet to be resolved as to the other parties.
