Judge denies motion to dismiss attempted homicide case

A Fayette County judge on Tuesday denied a motion to dismiss the attempted homicide case lodged against a Uniontown man accused of shooting another man in the shoulder in December.

William “Wee Wee” Smith, 39, is charged with shooting Malek Muhammad, 21, of Uniontown on Dunlap Street on Dec. 23. Muhammad testified before President Judge Gerald R. Solomon that the bullet ricocheted internally, bruising a rib and puncturing one of his lungs.

Muhammad testified under questioning from Assistant District Attorney Gene Grimm that he was at an eatery when he saw Smith, whom he’d never spoken to, but recognized from seeing him around. He testified that when he left the business, Smith approached him on the street and asked if he was the same man who was inside. When he told him he was, Muhammad testified, Smith shot him.
