A preliminary hearing for a California man who police allege shot his 12-year-old brother at a residence in Uniontown on Sept. 30 was continued for a third time this morning.

Uniontown police Detective Donald M. Gmitter said David Dwayne Brooks, 19, of 205 Fifth St. was charged before Magisterial District Judge Ronald J. Haggerty Jr. with aggravated assault, two counts of simple assault, recklessly endangering another person and carrying a firearm without a license for shooting his brother Timothy Brooks.

Fayette County Assistant District Attorney J.W. Eddy said he requested the continuance after the father of the brothers, Russell Brooks of Uniontown, expressed his concern in the courtroom prior to the hearing for the well being of his 12-year-old son should he have to take the stand.
