Fayette judge denies request for bond modification, photo lineup suppression in rape case
A Fayette County judge has denied bond modification and suppression of a photo lineup in a New Salem man’s rape case, but granted a request for surveillance footage along with the alleged victim’s telephone records.
Senior Judge Gerald Solomon entered the order in the case lodged against Rahmel Williams, 41.
Williams’ attorney, Assistant Public Defender Shane Gannon, asked Solomon to modify Williams’ $500,000 bond, noting that his client had family in the area and had turned himself in to police to be arraigned on 12 charges, including rape, involuntary deviate sexual intercourse, aggravated assault, kidnapping, simple assault, tampering with evidence and reckless burning or exploding.
Solomon’s order also denied Gannon’s request to dismiss the charges and to suppress the eight-page photo lineup that the alleged victim used to identify Williams.
Williams allegedly raped a woman in a remote area of Craig Lane on June 5, causing the alleged victim severe injuries that led to her colon being removed.
Williams allegedly burned his girlfriend’s vehicle that he drove on the night in question.
The girlfriend reportedly told police Williams told her that he went to Ohio, but she identified Williams through surveillance footage.
In Gannon’s motion was a request for the alleged victim’s cellphone records from 12 a.m. June 4 to 12 a.m. June 6 that would be relevant to the defense.
Gannon also made a request for Parks Casino Bar to release any and all surveillance video from June 4 to June 5, as Gannon claims the commonwealth did not present sufficient evidence on the charges of rape, involuntary deviate sexual intercourse and kidnapping.
Solomon’s order directed prosecutors to provide the defense with the telephone information from the woman’s cellphone and home telephone in that time frame along with any surveillance video from the Parks Casino.
Williams remains lodged in the Fayette County Prison while awaiting trial.
