Woman charged with manslaughter in 12-year-old’s UTV death

A Waynesburg woman is facing charges in a side-by-side vehicle crash that allegedly killed a 12-year-old boy in August.

Tracy Lynn Russell, 44, was allegedly driving the utility task vehicle while intoxicated Aug. 8.

Marrius Duncan of Adrian allegedly died from injuries he sustained in the crash. He was pronounced dead that night in the Washington Health System Greene emergency room. Police say he was wearing  a helmet.

An autopsy ruled his cause of death accidental, caused by blunt force trauma.

Police interviewed Russell on the scene, where they said she had glassy eyes and slurred speech. A blood draw showed her blood-alcohol content was 0.13, according to the complaint.

The crash occurred on private property owned by Russell at 2680 Mount Morris Road in Franklin Township, according to the affidavit of probable cause.

Russell told police she was having a cookout and bonfire that night. Her boyfriend’s mother brought her foster children, she said. The children called the Yamaha Viking side-by-side the “buggie,” and asked for a ride.

The names of the children were removed from the complaint, but police said previously that a 17-year-old male, 11-year-old female and 7-year-old male were also involved in the crash. Duncan, the 11-year-old and 7-year-old were all wearing helmets, police said.

She told police it was daylight when she took the children for a ride.

She told police she was driving with two people in the front and two in the back, according to the affidavit.

She said she had only driven around the house about three times when it “tipped over.”

Russell is charged with involuntary manslaughter and four counts each of endangering the welfare of children and reckless endangerment filed before Magisterial District Judge D. Glenn Bates.
