Three men arrested after melee at the American Legion

The Trotter American Legion Post 762 on Ridge Boulevard was granted permission to reopen after a vote by the state American Legion in Harrisburg. The post was shut down after a melee in March.

State police fired shots at a man after a large disturbance at the American Legion in Dunbar Township on Sunday after he allegedly pointed a gun at a trooper.

Daylan M. McLee, 26, of Uniontown is facing aggravated assault and other charges after he allegedly refused to put down his weapon, prompting police to fire two rounds at him. He was not hit.

Police said a second man, Dustyn Grogan, no age listed, of Uniontown fired a handgun during the fight around 2:10 a.m.

Also during the same incident, Brian Craggette, 26, of Uniontown, was allegedly found to have a sawed-off shotgun in the trunk of his car parked at the American Legion.

After the incident, troopers said they saw McLee get into a silver sport-utility vehicle with two other men and flee the scene. A trooper ran after it on foot and reported the license plate number and description of the man through a police alert system.

Uniontown police conducted a traffic stop on the SUV and detained the three men.

According to the affidavit of probable cause, McLee initially denied involvement in the altercation. Police then showed him video surveillance of his alleged involvement.

“At that time, McLee admitted that he had lied during the initial interview and that he wanted to tell the truth,” the affidavit said.

He told police he took the gun from an acquaintance known to him as “Oshea” because other people were trying to take it from him, according to the affidavit. He said he threw the 9mm pistol in the grass before getting into the SUV.

He claimed he heard troopers say “drop it,” but said he did not think they were talking to him because, he said, he only had the pistol long enough to throw it in the grass.

He denied pointing the gun at the trooper, according to court paperwork.

McLee was charged with aggravated assault, illegal possession of a firearm, simple assault and reckless endangerment. He was arraigned on a $50,000 bond.

Grogan was charged with illegal possession of a firearm, firearm carried without a license, reckless endangerment, disorderly conduct and simple assault. He was arraigned on a $100,000 bond.

Craggette was arraigned on a $7,500 bond for an offensive weapon charge and firearm carried without a license.

All three men are lodged in Fayette County Prison in lieu of bond.

Multiple handguns, a sawed-off shotgun and marijuana were recovered from the scene. No injuries as a result of gunfire were reported. The investigation is ongoing.
