61-year-old man to stand trial for sexual assault of 13-year-old boy

A 61-year-old Perryopolis man was ordered to stand trial Tuesday after he allegedly forced sexual contact on a 13-year-old boy.

The boy testified that Daniel “Duke” Carl Fine called him into his house Sept. 9 and threatened to tell people the child he was gay if he did not comply with the contact.

Fine allegedly touched the child inappropriately and told him to touch him when the boy’s father called him from outside, according to testimony. The boy said Fine pulled up his pants and went outside.

“It just happened so fast. Like, I froze,” the boy said.

The 13-year-old said he went home with his father, where he told him about the alleged incident. The father called police, the boy said.

A verbal altercation between the alleged victim’s father and officials prompted a no-contact order between Fine and the boy’s family. A no-contact order between the alleged victim and suspect was already in place.

Fine is free from jail after a $125,000 bond was posted on his behalf Sept. 20.

Magisterial District Judge Daniel C. Shimshock held all of Fine’s charges for the Fayette County Court of Common Pleas. Fine is charged with involuntary deviate sexual intercourse of a person less than 16, unlawful contact with a minor, corruption of minors, coercion or threat to expose a secret, indecent exposure and indecent assault of a person less than 16.
