Both sides of wrongful-death lawsuit agree to dismiss Uniontown Hospital and doctor

Both sides in a wrongful-death lawsuit have agreed to dismiss several defendants, including Uniontown Hospital.

On Monday, U.S. District Judge Mark R. Hornak ordered the dismissal of defendants including Uniontown Hospital, Dr. Anthony D’Alessio and Fayette Regional Health System from the lawsuit filed on behalf of Barbara Quiroz as the administratrix of the estate of her late husband, Javier Quiroz.

Remaining as defendants in the lawsuit are MedExpress Urgent Care and its physician, Stacey Lyn Gallagher, D.O.

The suit claims that Javier Quiroz, 51, entered the MedExpress Uniontown on Dec. 2, 2014, with chest pains, nausea, shortness of breath, abdominal paint and diarrhea.

Gallagher examined and diagnosed him with gastroenteritis, food poisoning, unspecified chest pain, dehydration and headache and treated him with saline solution and medication for pain, nausea and shortness of breath.

He was diagnosed later that evening at Uniontown Hospital with acute community-acquired pneumonia, renal failure, systemic inflammatory response syndrome and an elevated white blood count.

He passed away at 2:55 a.m. Dec. 3, 2014, from multi-system organ failure, acute left upper lobe pneumonia and complications from an infection.
