Washington County man free on $100K bond in Fayette County shooting

A Washington County man is free on $100,000 bond following a Fayette County judge’s decision that not enough evidence was presented to keep him in prison without bail for shooting and killing another man last year.
Fayette County Judge Steve Leskinen filed a final bail order for Nathan Yasek, 36, of Eighty Four that determined that Yasek was entitled to bail in the amount of $100,000.
Yasek was charged with criminal homicide, two counts of aggravated assault and recklessly endangering another person following an incident on Nov. 24 where he allegedly fatally shot Timothy C. Durst, 54, of Uniontown in the parking lot outside of Rizz’s bar and restaurant.
Police said Yasek was urinating in the parking lot at his truck when Durst approached him from behind. After the shooting, police said Yasek went into the bar, where the county sheriff was, and told him he shot Durst in self defense. Yasek directed the sheriff to his gun, wallet and gun permit.
Yasek had been lodged in the Fayette County Prison since November and posted bail on March 28 following two hearings were Leskenin reviewed surveillance footage from a bank across the street from bar and restaurant.
However, after viewing a copy and then the original surveillance footage, Leskinen indicated that the poor quality of both videos made it difficult to determine the precise location where Yasek was standing when the shots were fired.
Leskinen added in his opinion that the pre-trial services from the Fayette County Adult Probation Office found that Yasek can be effectively supervised on home confinement and work release with electronic monitoring.
