Man wanted on Virginia felony warrants arrested at South Union restaurant
A man who Virginia investigators were tracking for numerous alleged felony offenses was arrested by local police Saturday at El Patron Mexican Grill.
Cody Antwan Miller, 34, of Charlotte, North Carolina, allegedly tried to flee police and gave them a fake name at the Wayland Smith Drive restaurant.
He was denied bail and lodged in Fayette County Prison Sunday morning on charges of flight to avoid apprehension, resisting arrest, false identification and disorderly conduct.
According to North Carolina’s sex offender registry, Miller was convicted May 7, 2008, of aggravated sexual battery committed May 24, 2007, in Norfolk, Virginia. Police in Norfolk issued two probation violation warrants for Miller March 20.
A lieutenant with the Virginia Department of Corrections called state police in Uniontown on Saturday to report they were tracking Miller because of an active parole violation stemming from “numerous felony offenses.”
The pinged cellphone location showed Miller at the Super 8 motel in South Union Township, then at El Patron, according to the affidavit of probable cause filed in his case.
State police and Uniontown City Police saw a man matching Miller’s description in a booth who appeared nervous.
Police told him twice he was under investigation for a warrant, and he allegedly told police twice his name was Oshea Williams. He allegedly tried to push through police aggressively and run toward the door. Police deployed Tasers, and he was taken into custody after a struggle, police said.
Police said a significant number of customers were in the restaurant at the time, causing alarm and creating a public inconvenience.
