Police file additional fraud charges against Carmichaels man

State police filed additional charges against a Carmichaels man who is accused of defrauding dozens of customers through his asphalt business.

Two North Union Township residents, both over the age of 60, have accused Brian Roy Kozy, 41, of accepting money for work that was never finished. Kozy is the owner of Seal-Rite asphalt

A total of 19 people have now accused Kozy of having them sign an agreement and pay a deposit for asphalt work that was not completed.

According to criminal complaints, whenever the alleged victims spoke with Kozy, he cited various reasons for the delays such as personal injuries, family illnesses, equipment malfunctions and the need for specialized asphalt from Canada.

According to the most recent criminal complaint, Kozy stole $1,720 from two customers between May and September.

Kozy faces felonies of deceptive or fraudulent business practices, receiving advance payment for services and failing to perform and theft by deception.

Between the four cases, Kozy now faces a total of 53 charges.

Kozy is set to be arraigned on the new charges this week before District Judge Daniel Shimshock.
