I want to ask how it is possible that a person be charged with a felony for theft by deception, be given probation and restitution of over 8,000. dollars and be able to not make their payments and not be in violation of their probation?

I was ripped off three years ago. It took many hearings and then court to get to a final determination of his pleading guilty, and being given a felony charge with probation and restitution of $8,046.

He missed the first payment,  and when I called the probation officer, he said it’s hard to violate them on just missed payments. But isn’t the payments part of the agreement to have probation. I called the judge’s chambers and the woman I spoke with agreed with me on that. It’s also a fact that if you have a minor parking or speeding ticket and you miss your fine payment, the very next day you have a warrant for your arrest.

So, how is this fair? Ony in our judicial system. I am perplexed. I feel not only was I wronged by this person, but I am continuing to be wronged by the faulty judicial system now. The law needs changed. This person should not be able to rip someone off for $8,000, get a felony charge, not make his payments and still be on probation.
