Man sentenced to prison for sex assault

An Everson man sobbed, rocking back and forth on Wednesday, when a Fayette County judge rejected an intermediate punishment sentence for statutory sexual assault and instead ordered him to serve time in the county prison.

Shawn Charles Egenlauf, 23, was sentenced to serve six to 23 months as part of his guilty plea to four counts each of statutory sexual assault and indecent assault and one count of corruption of minors. President Judge Gerald R. Solomon said he would not sentence Egenlauf to intermediate punishment, which would have allowed him to serve house arrest and a probationary-type sentence, because of the nature of the charges.

Police charged Egenlauf with having sex with a 15-year-old girl between Jan 1 and Feb. 15, 2011. The two had sex at least four times, police said, and the girl became pregnant. The teen gave birth to the child last fall, police said.

The Herald-Standard does not identify sex assault victims.

Solomon gave Egenlauf credit for time served between March 21 and May 15.

He has been free on bond since then. As part of his sentence, Egenlauf cannot have any contact with the victim while he is on parole, Solomon said.

In handing down the sentence, Solomon noted that statutory sexual assault is punishable by up to 10 years in prison.

When Solomon asked Egenlauf if he understood his appeals right, Egenlauf tearfully told the judge he thought he did.

“I guess, I don’t know,” Egenlauf said.

Solomon told Egenlauf’s attorney, Assistant Public Defender David Kaiser, to make sure someone from the office talks to Egenlauf to make sure he understands his rights.

Assistant District Attorney Anthony Iannamorelli indicated that as part of the plea deal, four charges of aggravated indecent assault were to be dismissed.

Solomon entered paperwork dismissing those charges.
