Smock man sentenced for rape

A Smock man was sentenced to six to 12 years in prison for raping a woman at her home in February.

Stephen Emil Wagner, 50, will have to register his address with police for the rest of his life, and will be subject to community notification as part of the Tuesday sentence handed down by Fayette County President Judge Gerald R. Solomon.

State police charged Wagner with grabbing the victim’s hair, banging her head off the floor and then raping her in her Smock home on Feb. 6. Wagner also held the woman against her will.

HeraldStandard.com does not identify victims in sexual assault cases.

Assistant District Attorney Gene Grimm said the victim was present for the sentencing.

Wagner, represented by Assistant Public Defender Benjamin Goodwin, entered guilty pleas to two charges each of rape and aggravated indecent assault and one count each of involuntary deviate sexual intercourse, simple assault, unlawful restraint and simple assault. An evaluation done by a member of the state’s Sexual Offenders Assessment Board determined that Wagner is not a sexually violent predator. Such a designation puts additional conditions upon a defendant when they are released from prison.
