W.Va. man charged with indecent exposure admitted to ARD

A West Virginia man accused of exposing his genitals at a store in South Union Township in June was admitted to the Accelerated Rehabilitative Disposition program in Fayette County Court on Tuesday.

Michael Frederick Yost, 38, of Parkersburg, W.Va., who was charged with indecent exposure, open lewdness and disorderly conduct, was admitted to six months in the ARD program by Senior Judge Ralph C. Warman.

In order to successfully complete the program and have the charges dismissed from his record, Yost must pay associated court costs, refrain from using alcohol and controlled substances, meet with a probation officer regularly, and perform 50 hours of community service within 60 days.

Yost’s attorney, Vincent Tiberi, asked Warman to consider waiving or reducing Yost’s community service requirement because Yost lives and works full-time in another state. Tiberi said performing community service in Fayette County would be difficult. Warman instead suggested that Yost do his community service in Parkersburg.

Yost’s charges stemmed from an incident at Kmart, where an employee observed him entering the store a little before 11 a.m. and then touching his exposed genitals. Store surveillance footage also showed Yost engaged in the activity.

The arresting officer testified that Yost said shortly after his arrest that he couldn’t explain why he was exposing and touching his genitals in the store, but Tiberi indicated that there was an issue with the medication Yost was taking.
